Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fiitx — the enterprise AI-agent platform provided at x.fiit.ai and as a desktop application for macOS and Windows (together, the "Service"), operated by Quanse Caixiang (Beijing) Technology Co., Ltd. (全色猜想（北京）科技有限公司, a company incorporated in the People's Republic of China) ("Fiitx", "we", "us"). By creating an account, subscribing, or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

1. The Service

Fiitx provides "task-grade" AI agents and a managed, multi-provider AI model gateway (text, image and video), together with an agent runtime, connectors to third-party tools, skills, long-term memory, scheduled automations, and per-workspace data isolation. Features and included model tiers depend on your subscription plan.

2. Accounts and workspaces

• You are responsible for the accuracy of your account information and for all activity under your account.
• You must keep your credentials secure and notify us of any unauthorized use.
• Data in a workspace (chats, agents, skills, memory, knowledge, usage and billing) is isolated per workspace. Team owners and admins control member access.

3. Subscriptions, credits and billing

• Paid plans (Starter, Plus, Pro) are billed monthly in advance. Usage of AI models is metered in a single "credit" unit; each plan includes a monthly credit allotment and a model tier.
• International payments are processed by our payment provider (Waffo); payments in mainland China are processed via WeChat Pay through our payment bridge. We do not store full payment card numbers.
• Where a plan is set to auto-renew, it renews each period until canceled; canceling stops future renewals and the current period runs to its end. For non-auto-renew (WeChat) plans, access lapses at period end unless renewed.
• On expiry, premium model tiers and video generation pause; your remaining credit balance is retained. Except where required by law, fees are non-refundable.
• We may change prices or plan contents on a prospective basis, with notice for active subscribers.

4. Acceptable Use Policy (AUP)

This Acceptable Use Policy applies to all use of the Service, and in particular to content you create with our generative features (including image generation, video generation, image-to-video, voice cloning and voice generation). You are responsible for the inputs you provide and the outputs you generate, store, or distribute.

4.1 Content standards — prohibited content

You must not use the Service — including any generative feature — to create, upload, store, or distribute:

• Sexual / NSFW content. Pornographic or sexually explicit material, and any sexual content involving minors (which is strictly prohibited and addressed separately below).
• Violence / gore. Content that depicts, glorifies, or incites graphic violence, gore, self-harm, or cruelty.
• Hate speech. Content that harasses, degrades, or incites hatred or violence against people based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or any protected characteristic.
• Child sexual abuse material (CSAM) and child-unsafe content. Any content that sexualizes, exploits, or endangers minors. This is a zero-tolerance category; we remove such content, terminate the account, preserve relevant records, and report to the appropriate authorities and hotlines as required by law.
• Deepfakes / impersonation. Realistic synthetic media of a real, identifiable person (including via voice cloning or face swapping) created without that person's consent, or content intended to deceive others about who created or said something, to defraud, or to spread disinformation.
• Copyright / trademark infringement. Content that infringes the intellectual property of others, including reproducing copyrighted works or using trademarks or brand assets without authorization.

For voice cloning and generation specifically, you must have the necessary rights and consent to any voice you clone or reproduce, and you must not use synthesized voices to impersonate real individuals deceptively.

4.2 Prohibited conduct

You also agree not to use the Service to:

• violate any law or third-party right, or infringe intellectual property;
• distribute malware, spam, or deceptive content;
• attempt to breach security, reverse engineer, or circumvent usage limits or billing;
• resell or provide the Service to third parties except as expressly permitted;
• use connectors or automations to access systems you are not authorized to access.

You must also comply with the terms of any third-party services you connect (e.g. messaging, commerce, or model providers), and with the usage policies of the underlying AI model providers.

4.3 Enforcement actions

If we determine that content or conduct violates this AUP, we may, at our discretion and depending on severity: issue a warning; remove or disable access to the offending content; restrict, suspend, or disable specific features (including generative features); suspend or terminate the account; withhold or reverse related credits; and, where legally required (for example, CSAM), preserve records and report to the relevant authorities. Serious or repeated violations may result in immediate termination without refund.

4.4 Reporting

To report content or activity that you believe violates this AUP — including illegal content, CSAM, deepfakes/impersonation, or IP infringement — email baipengfei@fiit.ai with a description and, where possible, a link or reference to the content. We review reports promptly and prioritize child-safety and other urgent reports.

4.5 Content moderation

We combine safety measures from the underlying AI model providers (input/output filters that block certain categories of generation) with our own review of reported content. We may review, remove, or restrict content and accounts to enforce this AUP and comply with law. We do not proactively monitor all content, and applying these measures does not make us responsible for user-generated content; responsibility for content you create and distribute remains with you.

5. Your content

You retain ownership of the content and data you submit ("Your Content"). You grant us a limited license to process Your Content solely to operate and provide the Service, including routing prompts and inputs to third-party AI model providers to generate outputs. You are responsible for ensuring you have the rights to submit Your Content and to have it processed this way.

6. AI outputs

AI-generated outputs may be inaccurate or incomplete. Although Fiitx applies guardrails and data-grounding to reduce fabrication, you are responsible for reviewing outputs before relying on them, and outputs are not professional (legal, financial, medical) advice.

7. Third-party services

The Service integrates with third-party providers (AI model providers, connectors, and payment processors). Your use of those services is governed by their terms, and we are not responsible for their acts or omissions.

8. Intellectual property

The Service, including its software, models we provide access to, and branding, is owned by us or our licensors and is protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service per your plan.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, Fiitx will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our aggregate liability for any claim is limited to the amounts you paid for the Service in the twelve months before the event giving rise to the claim.

11. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access for breach of these Terms or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive will survive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-laws rules, and disputes will be resolved by the competent people's courts in Haidian District, Beijing, PRC.
